Welcome to New Earth Ceramics ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website located at https://www.newearthceramics.com (the "Site") and any purchases made through it.

By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

1. Products and Orders

We offer handcrafted ceramics and related goods. Due to the handmade nature of our work, each piece is unique and may feature slight variations from the photographs shown.

All orders are subject to acceptance and availability. We reserve the right to cancel or refuse any order for any reason, including inventory errors or pricing inaccuracies.

2. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice.

We accept payment via secure third-party payment processors. By submitting your payment information, you authorize us to charge the applicable amount.

3. Shipping and Delivery

We currently ship within the United States only.

Once an order has been handed off to the carrier (e.g., USPS), risk of loss passes to the buyer. We are not responsible for delays, damages, or loss caused by the carrier after shipment.

If your order is damaged during transit, please contact us within 5 days of delivery with photographs of the damage. Eligible claims will be refunded; however, due to the unique nature of each piece, replacements are not available.

If tracking indicates an order was delivered but you have not received it, you are responsible for contacting your local post office to investigate. We are not responsible for packages marked as delivered by the carrier.

4. Returns and Refunds

All sales are final.

We do not accept returns, exchanges, or cancellations once an order has been placed, except in the case of damage during shipping (see above). If you have concerns about your order, please contact us promptly.

5. Custom and Made-to-Order Items

Custom orders, when accepted, are non-refundable and non-cancellable once production has begun. Because ceramics involve significant research, development, and production time, all custom work is final.

6. Taxes

Sales tax will be applied to orders shipped within jurisdictions where we are legally required to collect tax. At this time, we do not ship internationally and are not responsible for VAT, customs duties, or import taxes.

7. Intellectual Property and Content Usage

All content on this Site — including but not limited to text, images, graphics, logos, and designs — is owned by or licensed to New Earth Ceramics and is protected by copyright and intellectual property laws.

You may share our images or content for personal inspiration (such as on Pinterest or personal social media) provided that proper credit is given and a link to https://www.newearthceramics.com is included.

Commercial use, modification, reproduction, or redistribution of any content without prior written permission is strictly prohibited.

8. User Conduct

You agree not to misuse the Site, including attempting to gain unauthorized access to our systems, interfering with service operations, or violating any applicable laws.

You must be at least 18 years old to use this Site.

9. Wholesale and Resale

We permit purchases for wholesale and resale purposes with prior agreement. For inquiries regarding wholesale orders, please contact us directly.

10. Force Majeure

We are not responsible for any delay or failure to perform due to events beyond our control, including but not limited to acts of God, natural disasters, pandemics, labor strikes, shipping disruptions, or governmental actions.

11. Limitation of Liability

To the fullest extent permitted by law, New Earth Ceramics shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Site or purchase of products. Our total liability for any claim related to a purchase shall not exceed the amount paid for the product.

12. Dispute Resolution

Any disputes arising out of or related to your use of this Site or any purchases shall be resolved exclusively through binding arbitration, conducted in Los Angeles, California, in accordance with the rules of the American Arbitration Association. Either party may seek relief in small claims court for qualifying claims. You agree to waive any right to a jury trial or to participate in a class action.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes become effective constitutes acceptance of those changes.
